Hub132 LLC ("hopSIM", "we", "us", or "our") operates the hopsim.app website and associated mobile applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time, effective immediately upon posting on the Service. Your continued use of the Service following any changes constitutes acceptance of those changes. We will note the date of the most recent updates at the top of this page.

1. Acceptance of Terms

2. Service Description

hopSIM provides eSIM connectivity services for international travelers, enabling access to mobile data networks in over 190 countries. Our Service includes the purchase, activation, and management of eSIM data plans through our website and mobile applications.

3. Account Registration

To use certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Purchases and Payments

We accept payment via major credit cards (Visa, Mastercard) and other payment methods as indicated on the Service. All purchases are subject to acceptance and availability. Prices are displayed in multiple currencies, and you will be charged in the currency you select at checkout.

By providing payment information, you represent and warrant that you are authorized to use the payment method. All sales are final unless otherwise specified in our Refund Policy. Refunds, if applicable, will be issued to the original payment method.

5. eSIM Activation and Usage

eSIM plans must be activated according to the instructions provided. Data allowances, validity periods, and coverage areas are specified for each plan. You are responsible for:

• Following activation instructions correctly
• Monitoring your data usage and plan validity
• Understanding that unused data does not roll over and expired plans cannot be refunded

• Infringes upon the intellectual property rights of others
• Transmits malicious code, viruses, or other harmful materials

7. Intellectual Property

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUB132 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Network coverage, speed, or quality issues
• Device compatibility issues

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hub132 LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New Jersey, and you hereby consent to personal jurisdiction and venue therein.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Hub132 LLC concerning the Service and supersede all prior agreements and understandings, whether written or oral.
